Terms of Service

1. Acceptance of Terms

By accessing, using, inviting, or interacting with the 7.6.2 Bot ("the Bot", "our Bot", "this Bot") in any capacity whatsoever, you ("the User", "you", "your", "the End User") explicitly acknowledge, accept, and agree to be legally bound by these Terms of Service ("Terms", "TOS", "Agreement", "Legal Agreement") in their entirety, without exception, modification, or reservation. If you do not agree to these Terms, you must immediately cease all use of the Bot and remove it from any Discord servers under your control or administration.

These Terms constitute a legally binding agreement between you and the Bot's creator(s), developer(s), owner(s), and operator(s) ("we", "us", "our", "the Creator", "the Developer", "the Owner"). Your continued use of the Bot following any modifications to these Terms shall constitute your acceptance of such modified Terms.

2. Disclaimer of Liability

You expressly acknowledge and agree that:

• The Bot is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, representations, or guarantees of any kind, whether express, implied, statutory, or otherwise.
• The Creator assumes no responsibility for how the Bot is utilized, deployed, or operated by end users.
• Any damage, disruption, data loss, server modification, channel deletion, message spamming, or any other action performed by the Bot is entirely the responsibility of the user who initiated such action.
• The Creator shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with your use of the Bot.
• The Creator is not responsible for any violations of Discord's Terms of Service, Community Guidelines, or any other platform policies that may result from your use of this Bot.

3. User Responsibility and Accountability

By using this Bot, you accept full and complete responsibility for:

• All actions performed by the Bot on your behalf or at your direction, whether intentional or unintentional.
• Any consequences arising from the use of the Bot's commands, features, or functionalities.
• Ensuring that your use of the Bot complies with all applicable laws, regulations, and platform policies.
• Any harm, damage, or disruption caused to Discord servers, communities, or individual users as a result of your use of the Bot.
• Obtaining all necessary permissions, authorizations, and consents before using the Bot in any Discord server.
• Any legal action, dispute, or claim that may arise from your use of the Bot.

4. Assumption of Risk

You acknowledge and accept that the use of this Bot carries inherent risks, including but not limited to:

• Potential violation of Discord's Terms of Service, which may result in account suspension, termination, or permanent ban.
• Possible legal consequences in your jurisdiction for certain uses of the Bot.
• Risk of server damage, data loss, or unintended modifications to Discord servers.
• Potential retaliation or response from affected users, communities, or platforms.
• Any other foreseeable or unforeseeable consequences that may arise from the Bot's use.

By using this Bot, you voluntarily assume all such risks and agree to hold the Creator harmless from any and all claims, damages, losses, or liabilities arising therefrom.

5. Indemnification

You agree to indemnify, defend, and hold harmless the Creator, along with their affiliates, officers, directors, employees, agents, licensors, and suppliers, from and against any and all claims, actions, demands, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use or misuse of the Bot.
• Your violation of these Terms.
• Your violation of any rights of another party, including any Discord users or server owners.
• Your violation of any applicable laws, rules, or regulations.
• Any content or data you transmit through or using the Bot.

6. No Warranty

THE BOT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THE CREATOR DOES NOT WARRANT THAT THE BOT WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

The Creator makes no representations or warranties regarding:

• The accuracy, reliability, or completeness of the Bot's functionality.
• The Bot's compatibility with Discord's current or future platform updates.
• The availability or uptime of the Bot.
• The security of any data processed by the Bot.
• The legality of the Bot's use in any particular jurisdiction.

7. Limitation of Liability

In jurisdictions that do not allow the exclusion or limitation of liability for consequential or incidental damages, the Creator's liability shall be limited to the maximum extent permitted by law.

8. Prohibited Uses

While the Creator disclaims all responsibility for how the Bot is used, you acknowledge that the following uses may violate Discord's Terms of Service and/or applicable laws:

• Using the Bot to harass, threaten, or harm other users.
• Using the Bot in servers where you do not have authorization.
• Using the Bot to spread malware, phishing links, or other harmful content.
• Using the Bot to violate any applicable laws or regulations.
• Using the Bot in any manner that could damage, disable, overburden, or impair Discord's services.

The Creator is not responsible for enforcing these prohibitions and shall not be held liable for any violations thereof.

9. Third-Party Services

The Bot operates on and interacts with Discord's platform. The Creator has no control over and assumes no responsibility for Discord's services, policies, or actions. Your use of Discord is governed by Discord's own Terms of Service and Privacy Policy, and you acknowledge that the Creator is not affiliated with, endorsed by, or sponsored by Discord Inc.

10. Modifications to Terms

The Creator reserves the right to modify, amend, or update these Terms at any time, with or without notice. Continued use of the Bot following any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.

11. Termination

The Creator reserves the right to terminate, suspend, or restrict access to the Bot at any time, for any reason, without prior notice or liability. Upon termination, all rights granted to you under these Terms shall immediately cease.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

13. Entire Agreement

These Terms constitute the entire agreement between you and the Creator regarding your use of the Bot and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Bot.

14. Waiver

The failure of the Creator to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the Creator.

15. Contact Information

For any questions regarding these Terms of Service, you may attempt to contact the Bot's creator through the Discord server linked on the dashboard. However, the Creator is under no obligation to respond to any inquiries.

16. Acknowledgment

BY USING THIS BOT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. YOU FURTHER ACKNOWLEDGE THAT THESE TERMS CONSTITUTE A COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN YOU AND THE CREATOR, AND THAT THEY SUPERSEDE ANY PROPOSAL OR PRIOR AGREEMENT, ORAL OR WRITTEN, AND ANY OTHER COMMUNICATIONS BETWEEN YOU AND THE CREATOR RELATING TO THE SUBJECT MATTER OF THESE TERMS.
